This website is operated by Eartha & Wolf Ltd. Throughout the site, the terms “we”, “us” and “our” refer to Eartha & Wolf Ltd. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following Terms & Conditions. Where you do not accept these Terms & Conditions in full, you do not have permission to access the contents of this website and should cease using it immediately.

DEFINITIONS

  1. BESPOKE: Goods which are designed and produced to your exacting requirements, this may include the use of existing pieces and/or materials not originally purchased from Eartha & Wolf
  2. CHARGES: the charges payable by you to us for the supply of the Goods in accordance with the Terms & Conditions
  3. GOODS: the goods (or any part of them) set out in the Order, including Bespoke, Made to Order, Personalised, Ready to Wear and Vintage items
  4. MADE TO ORDER: Eartha & Wolf produced Goods which are pre-designed and produced to order. These Goods may include variant choices such as stone type, size and colour 
  5. ORDER: your order for Bespoke, Made to Order, Personalised, Ready to Wear or Vintage Goods, whether in-person or online 
  6. PERSONALISED: Goods which are personalised to your exacting requirements, which includes altered, engraved and resized items   
  7. READY TO WEAR: Eartha & Wolf produced Goods which are in stock and ready to ship
  8. VINTAGE: Goods which are not Eartha & Wolf produced, which includes vintage and antique items 
  9. WE/US/OUR: Eartha & Wolf Ltd, registered in England with company number 15615097
  10. YOU: the person who purchases Goods from us

OUR CUSTOMER SATISFACTION PLEDGE

Bespoke, Made to Order and Personalised items are made or altered especially for each customer. As such, these items are unable to be exchanged or returned. However, customer satisfaction is extremely important to us, so if you have any issues with your Order, we will strive to find a resolution as quickly as possible on a case-by-case basis. Please see below for more information.

RETURN & REFUND POLICY

CANCELLATIONS

If you have changed your mind or have made a mistake and wish to cancel your online order before it has been dispatched, please email customercare@earthaandwolf.com as soon as possible after submitting payment. While we will do our best to accommodate cancellation requests made within 30 minutes, cancellation may not be possible once an order has entered the manufacturing or fulfilment process.

RETURNS

We are confident you will adore your Eartha & Wolf piece. However, should you wish to request an exchange or refund you must do so within the first 14 days of receiving your order by emailing customercare@earthaandwolf.com. Please note that we do not accept returns on Bespoke, Made to Order or Personalised items, unless the item is faulty, damaged, or not as described. 

Once your request has been approved, you will have a further 14 days to return the item to us. Returned items must be in their original condition, unused, undamaged, and returned with the original Eartha & Wolf packaging. When returning an order, you are responsible for the cost of return postage and for ensuring the item is securely packaged so it arrives back with us in good condition. We strongly recommend using a tracked and signed-for service and insuring the parcel for the full sale value. You must retain proof of postage. Eartha & Wolf cannot accept responsibility for items that are lost or damaged in transit.  

Nothing in these terms affects your statutory rights under UK consumer law, including your rights in relation to faulty or misdescribed goods. 

EXCHANGES

Please kindly note that we only accept exchanges on unaltered items from the Vintage and Ready to Wear collections. All other items, including Bespoke, Made to Order and Personalised Goods, are not eligible for exchange.

Once the returned item is received by us and inspected you shall be notified by email if your exchange request has been accepted. If you are exchanging your returned item for a higher value product, the difference in price must be paid before dispatch. Partial refunds for lower priced items will be issued on receipt of delivery to the customer. For products that have been purchased using an Eartha & Wolf gift card, please refer to the E-Gift Card terms and conditions. 

REFUNDS

Please kindly note that we only offer refunds on unaltered Vintage and unaltered Ready to Wear items and items that are proven to be incorrectly received, damaged or defective. All other items, including Bespoke, Made to Order and Personalised Goods, are non-refundable. Refunds will be processed according to the original method of payment. For bank transfers and credit or debit card refunds, please allow up to 5 working days (Monday to Friday, excluding Bank Holidays) for the funds to clear.

FAULTY ITEMS

If you receive an item that is damaged or not what you ordered, you have 30 days from receiving your item to notify us and request a refund or replacement. Please send images clearly detailing your concern. The item will need to be returned to us for review before we are able to process a refund or replacement. We reserve the right to refuse a return on any items which we do not deem to be faulty.

NO BUY-BACK POLICY

Eartha & Wolf does not operate a product buy-back or resale programme. We are under no obligation to repurchase products from customers at the original purchase price, current market value, or any other amount. This applies to all products, including Bespoke and Made to Order jewellery. Nothing in this clause affects your statutory rights under UK consumer law or any valid rights under our returns policy.

COMPLAINTS & ALTERNATIVE DISPUTE RESOLUTION

We are proud members of the National Association of Jewellers (NAJ). As an NAJ retailer we abide by the Association's Code of Conduct, based on honesty, integrity and professionalism. As such we are committed to resolving any complaints as quickly and fairly as possible. If you are dissatisfied with our goods or services, please contact us so we can attempt to resolve the issue. If we are unable to reach a resolution, eligible consumer complaints may be referred to NAJ Resolve, the National Association of Jewellers’ independent Alternative Dispute Resolution (ADR) service approved by the Chartered Trading Standards Institute (CTSI). NAJ Resolve provides a fair and impartial process for resolving disputes between consumers and NAJ members. Further details are available at: https://www.naj.co.uk/resolve

SHIPPING POLICY

Eartha & Wolf offer complimentary shipping on all domestic and international orders. At this moment in time, we exclusively ship to the UK and Ireland, the European Union, Canada, Australia and the United States of America. For these international destinations, we offer Delivered Duty Paid (DDP) shipping. Under DDP, we take responsibility for all costs associated with delivering your order to the specified address, including shipping charges, import duties, and taxes. This means the price you pay at checkout is the final cost, with no additional fees due upon delivery. If you wish to receive a shipment to a country not currently included, please email customercare@earthaandwolf.com to see if we can help.

We aim to ship Vintage and Ready to Wear pieces the next working day (Monday to Friday, excluding Bank Holidays), unless any personalisations are required. If resizing or engraving is requested please allow up to 5 working days before shipment. All Bespoke and Made to Order items are handcrafted in our London workshops so please allow approximately 4 to 8 weeks for dispatch. In some cases your piece may reach you sooner. Please be aware lead times may vary according to the season, such as during Christmas or public holidays, so be sure to allow plenty of time for your order to reach you for any special occasions. Please email customercare@earthaandwolf.com if you have any special dates and we will do our best to accommodate you. 

Once your item has been shipped, delivery times will vary depending on the shipping destination. Please refer to the shipping chart below. You will be provided with a dispatch email and tracking information for all Orders.

Eartha & Wolf’s bespoke process is explained here on the website. Once your Bespoke item has been completed, you will receive a dispatch email and tracking information. 

All shipments are discreetly packaged for maximum security. Each item is tracked, fully insured and will require a signature upon delivery. Please note that any missed deliveries may incur a rescheduling fee.

Deliveries to Islands (for example, Tenerife, Majorca, Sicily, etc.) may incur an out of area delivery fee of £24.00. Where necessary, you will be provided with further information, as well as more accurate delivery fees upon order confirmation.

Please be aware that certain couriers and/or countries issue restrictions when shipping gems, precious stones, jewellery and watches. Therefore, please be aware of your own geographic import restrictions before placing an order with us. Please be aware international shipments, including those to the EU will be subject to customs checks, which may cause delays. 

PERSONALISED GOODS

Eartha and Wolf provide complimentary resizing for all rings purchased from the Vintage and Ready to Wear collections. This is limited to one resize per item and must be stipulated at the time of purchase. Please note that the range of ring sizes available for each product is determined by the specific design and its suitability for resizing. If you would like to request a size that is not currently listed within the product page of our website, please get in touch and we will do our best to accommodate you.

For online Orders containing rings, we recommend that you refer to our size guide before completing your purchase. 

For engraving or other personalisations, please contact us at customercare@earthaandwolf.com to ascertain prices and lead times. Personalisations such as resizing and engraving take approximately 3-5 working days from Order to dispatch.

Please note that Personalised Goods are non-returnable. 

AFTERCARE SERVICE

We are dedicated to upholding the highest level of customer care, and as part of this pledge, we offer a comprehensive aftercare service on all products purchased from Eartha & Wolf. Our aftercare service includes providing documentation for insurance valuations, as well as the opportunity to have your piece/s regularly checked and cleaned by our team of professional jewellers. We are also available to discuss and where relevant, provide quotes for any necessary post-purchase repairs or alterations. Please contact customercare@eathaandwolf.com quoting your order number to arrange an aftercare appointment, which can be conducted remotely or at our London studio.

ENGAGEMENT RING AFTERCARE

We are delighted you have chosen an Eartha & Wolf ring to mark this momentous occasion, and we understand how important it is that your purchased engagement ring has the perfect fit. Therefore, as part of our Engagement Ring Aftercare package, any engagement ring purchased from Eartha & Wolf, including Bespoke items and those from the Made to Order, Ready to Wear and Vintage collections (including antique) will be eligible for one complimentary ring resize, which must be claimed within the first 6 months of purchase. As part of the Engagement Ring Aftercare package, we also offer personalised sizing advice by appointment, either in person at our London based design studio, or remotely, via video call. Please contact customercare@earthaandwolf.com with your order number and the purchaser’s full name to make enquiries.

BESPOKE TERMS & CONDITIONS

You acknowledge that Bespoke Goods are designed and made to order especially for you, and you therefore agree with the below Terms:

  1. that you shall comply with the payment conditions as set out in the Charges & Payment clause below;
  2. all Bespoke items are 100% non-refundable and non-returnable;
  3. Eartha & Wolf does not offer a buy-back or guaranteed resale service for any products, including Bespoke Goods. We are unable to repurchase items following completion and delivery of your order, except where required under applicable consumer law. 
  4. the date on which your Bespoke item will be ready is an estimation;
  5. you hereby give permission to us to use photos and/or videos of your Bespoke piece on our website, social media profiles and any other marketing material for the purposes of promoting our business. You have the right to withdraw consent at any time by giving written notice to us to customercare@earthaandwolf.com.

Prices quoted for Bespoke Goods are liable to change at any time and without notice. We reserve the right to modify or discontinue the bespoke service, or parts of the service, without notice.

We accept commissions for Bespoke products by appointment, either remotely or in person at our London studio. 

For the remote bespoke service, you will be continually updated throughout the process by email and where relevant, by telephone or video call. We shall do our best to remotely represent the discussed designs and materials as accurately as possible, but please note that the colours, textures, and other visual elements of stones and materials displayed in images may vary from their actual appearance in person. Factors such as lighting conditions, screen settings, and photography techniques can affect how these elements are perceived, and slight differences in colour and texture may occur when viewed in different environments.

In some cases, we may not be able to conduct the Bespoke commission remotely. You will be notified in advance if this is the case.

If you require amendments to your Bespoke item following delivery, you must notify us within the first 30 days. When shipping your item back to us, you are responsible for the cost of postage as well as ensuring that the item is fully insured, securely packaged and that it arrives in original condition to the delivery address provided by us. We recommend that you ship your item using a tracked and signed for service and you must retain proof of postage. We cannot be held responsible for any loss or damage occurred during transit.

All time frames quoted for repairs are estimated only. We do our best to carry out all services in a timely manner whilst keeping you fully informed throughout. However, we cannot be held responsible for any delays caused due to circumstances outside of our control.

CHARGES & PAYMENT

The Charges for Goods is the price specified on our website for online Orders, or indicated to you by us for in-person Orders. Although unlikely, it is possible that some of the Goods may be incorrectly priced, especially on our website. If we accept and process your Order where a pricing error has occurred, we may terminate the Terms & Conditions, refund you any sums you have paid and require the return of any Goods supplied to you.

We accept payment for online Orders by debit or credit card only. We accept debit or credit card and bank transfer payments for in-person Orders. In relation to payments by bank transfer totalling £10,000 or more (whether single or multiple transaction/s), we may be required by law to request from you and keep a record of proof of your personal identity, address and source of funds. If you are unable to satisfactorily provide us with the necessary identification documents, we reserve the right to refuse bank transfer payments.

For Bespoke Goods, all quotes provided are valid for a period of six months from the date of issuance, unless otherwise stated in writing. After the expiration of this period, the quote shall automatically become void and will be subject to revision based on current pricing, availability, and market conditions. Any acceptance of a quote after its expiration shall be at our sole discretion and may require a new quote to be issued. For Bespoke Goods, you must pay a deposit of 50% of the total estimated Charges (including VAT) at the time of confirming your Order. This is usually, but not always, upon approval of the estimation. The remaining balance following all final price adjustments must be paid in full (including VAT) prior to dispatch or upon collection of the completed item. 

For all other Goods (including Made to Order, Personalised, Ready to Wear and Vintage) you shall pay in full at the time of placing the Order, whether in-person or online. We shall not proceed with processing the Order or the delivery of the Goods until all amounts payable to us by you are paid in full and in cleared funds. 

All amounts due under the Terms & Conditions shall be paid in full without any set-off, counterclaim, deduction or withholding (other than any deduction or withholding of tax as required by law).

E-GIFT CARDS

Eartha & Wolf gift cards are for online use only and must be purchased and redeemed exclusively on the Eartha & Wolf website. Gift cards are valid for twelve months from the date of issue. Any remaining balance after the expiry date will be forfeited.

Once purchased online, the gift card, which contains a unique code, will be emailed directly to you or to your recipient, depending on which option you choose at checkout. 

Gift cards can be used to purchase products online. The recipient can redeem the value of a gift card by entering its unique code in the appropriate field at checkout. Gift card codes are not case sensitive. If the value of the purchase exceeds the available balance on the card, the difference must be paid using one of our accepted payment methods. If the total value of a purchase is less than the value of the gift card, the remaining balance will be retained on the gift card and can be used for future purchases within the validity period. 

Gift cards are non-refundable and cannot be exchanged for cash or other gift cards. Eartha & Wolf is not responsible for lost, stolen, or damaged gift cards. It is the customer’s responsibility to ensure that the gift card email is kept safe. In compliance with UK Distance Selling Regulations, customers are entitled to a 14-day cooling-off period for gift cards. The cooling-off period starts from the date of purchase, during which time the customer may cancel their purchase for any reason, provided the gift card has not been used. In these cases, Eartha & Wolf will deactivate the card upon cancellation and refund the total sum paid. To exercise your right to cancel, you must notify us at customercare@earthaandwolf.com within the 14-day period.

If you wish to return an item that has been purchased using a gift card, you may choose to exchange it for another product or receive a refund back onto the original gift card, which will retain its original expiry date. All exchanges, returns and refunds where a gift card was used for payment or part payment, are subject to the terms stipulated in our standard returns and refunds policy.

  • If the exchanged product costs less than the returned item, the difference will be returned to the original gift card, up to the original balance of that card, which will retain its original expiry date. For such purchases where a gift card was used in combination with another payment method, any additional funds exceeding the original gift card amount will be refunded according to our standard refund policy. 
  • If the exchanged product costs more than the returned item, the difference must be paid using one of our accepted payment methods prior to dispatch. 

Eartha & Wolf reserves the right to amend these Terms & Conditions at any time. Any changes will be effective immediately upon posting on our website.

GENERAL CONDITIONS

We reserve the right to decline any orders and/or refuse Service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

INTELLECTUAL PROPERTY & COPYRIGHT PROTECTION

All Eartha & Wolf jewellery designs, including but not limited to original creations, bespoke commissions, remodelled pieces, sketches, models, final products, and associated branding, are protected under UK copyright law and are the exclusive intellectual property of Eartha & Wolf. This protection extends to all unique designs, patterns and names associated with our jewellery.

Customers and third parties are prohibited from copying, reproducing, distributing, or using any of our designs without our express written permission. Any unauthorised use of our designs or intellectual property may result in legal action, including claims for infringement of intellectual property rights. We reserve all rights to enforce these protections to the fullest extent permitted by law.

ACCURACY, COMPLETENESS & TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk. This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

MODIFICATIONS TO THE SERVICE & PRICES

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

PRODUCTS & SERVICES

Certain products or Services may be available exclusively online through the website. These products or Services may have limited quantities and are subject to return or exchange only according to our Refund Policy, as stated above. We have made every effort to display as accurately as possible the colours and images of our products that appear in store. We cannot guarantee that your computer monitor's display of any colour will be accurate. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited. We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

ACCURACY OF BILLING & ACCOUNT INFORMATION

We reserve the right to refuse any Order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per Order. These restrictions may include Orders placed by or under the same customer account, the same credit card, and/or Orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an Order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the Order was made. We reserve the right to limit or prohibit Orders that, in our sole judgement, appear to be placed by dealers, resellers or distributors. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

PERSONAL INFORMATION

Your submission of personal information through the store is governed by our Privacy Policy, which can be viewed here.

ERRORS, INACCURACIES & OMISSIONS

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel Orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your Order). We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

PROHIBITED USES

In addition to other prohibitions as set forth in these Terms & Conditions, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable. You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you. You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products and Services delivered to you through the Service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement. In no case shall Eartha & Wolf Ltd, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

INDEMNIFICATION

You agree to indemnify, defend and hold harmless Eartha & Wolf Ltd and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms & Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SEVERABILITY

In the event that any provision of these Terms & Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms & Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.

TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms & Conditions are effective unless and until terminated by either you or us. You may terminate these Terms & Conditions at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. If in our sole judgement you fail, or we suspect that you have failed, to comply with any term or provision of these Terms & Conditions, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

FORCE MAJEURE

Neither you or us shall be in breach of the Terms & Conditions nor liable for delay in performing, or failure to perform, any of its obligations under the Terms & Conditions if such delay or failure result from an event or circumstance that is beyond our reasonable control, including without limitation, acts of God, flood, drought, earthquake, or other natural disaster, terrorist attack, war, riots, fire, strikes.

ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms & Conditions shall not constitute a waiver of such right or provision. These Terms & Conditions and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms & Conditions). Any ambiguities in the interpretation of these Terms & Conditions shall not be construed against the drafting party.

GOVERNING LAW
